In what seems to be a surprising move from the actress, it has been reported that Bijou Phillips has filed for divorce from Danny Masterson less than two weeks after he was sentenced to up to 30 years in prison for rape of two women. The two had been married for nearly 12 years and Phillips was found by her husband’s side through the entirety of his trial.

In her paperwork, Phillips cited “irreconcilable differences” as the reason for the split.

Phillips’ lawyer, Peter Lauzon, confirmed the divorce filing in a statement to the media, stating that for Phillips, “her priority remains with [their child].”

The statement read: “Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter. This period has been unimaginably hard on the marriage and the family. Mr. Masterson was always present for Ms. Phillips during her most difficult times of her life. Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter.”

Filed on Monday, the divorce petition requests full legal and physical custody of their child, as well as asking to “terminate the court’s ability to grant support” to Masterson, asking that their assets be divided up as separate property. She is also requesting that her name be reverted from Bijou Phillips-Masterson to Bijou Phillips and that she receive spousal support from Masterson.

In a letter to the judge before his sentencing on September 7th, Phillips described her husband as “a life-saving partner to me.”

After Masterson’s 30 year sentence was handed down, his wife was seen weeping in court before he blew a kiss in her direction as he was led from court.

The two rapes Masterson was convicted of are reported to have happened just before he began dating Phillips in 2003.
