A woman is suing Wendy’s fast-food chain after eating a contaminated burger which led to extensive medical treatment.
Court documents allege that Jena Vogt had been experiencing health issues and dealing with expensive medical bills after eating a meal that contained a preformed toxin.
The woman ordered a medium double hamburger meal at Wendy’s restaurant in St. Rose, LA on July 27.
The plaintiff explained that the burger was contaminated due to “poor handwashing procedures”. She also stated that the food was not washed or inspected for safety.
“Within 24 hours of consuming Wendy’s double cheeseburger, Mrs. Vogt felt nauseous and began to have gastrointestinal abnormalities,” the lawsuit stated.
Vogt was also diagnosed with sepsis, E. coli, cerebral hemorrhage, septic shock, and acute GI bleeding as well as other medical conditions.
She spent about two months in the hospital and had to be transferred to a second hospital on Aug. 28 before being released to home care on Sept. 28.
Her complaint states that the incident caused her physical and mental anguish. It also alleges that her husband Michael suffered mental duress due to changes in the relationship and a lack of consortium.
The couple is suing the fast-food chain for $75,000 which would cover “past and future lost opportunity for income and loss of enjoyment of life” as well as medical expenses.
The press has reached out to Wendy’s for comment, but they have not yet heard back.
